Cancellation & Refund Policy

This Cancellation & Refund Policy (“Policy”) forms an integral part of the Terms and Conditions of Toshan Travels (“Company”, “We”, “Us”, “Our”), operating through www.toshantravels.com. By accessing the website or availing any service, the customer (“Client”, “You”, “Your”) expressly acknowledges, understands, and agrees to be legally bound by this Policy.

1. Nature of Services & Role of Company

1.1 Toshan Travels acts solely as a booking facilitator and intermediary between the Client and third-party service providers, including airlines, hotels, transport operators, tour operators, visa facilitation centers, and other suppliers (“Suppliers”).
1.2 Toshan Travels does not own, control, or operate any airline, hotel, or travel service and shall not be deemed responsible for any act, omission, default, delay, or deficiency on the part of any Supplier.

2. Client-Initiated Cancellation

2.1 All cancellation requests must be submitted in writing through official communication channels of the Company.
2.2 Cancellation charges shall apply strictly in accordance with the cancellation policies of the respective Suppliers and may vary depending on the date, fare type, season, and service category.
2.3 The Client acknowledges that certain bookings may be fully non-refundable, and Toshan Travels shall not be liable for any such non-refundability.

3. Refund Policy

3.1 Refunds, if any, shall be processed strictly subject to approval and receipt of funds from the respective Supplier.
3.2 All service charges, professional fees, consultation charges, convenience fees, management fees, and processing charges charged by Toshan Travels are strictly non-refundable under all circumstances.
3.3 All visa-related fees, including but not limited to embassy fees, VFS fees, biometric charges, courier charges, and documentation fees, are non-refundable, regardless of visa outcome, delay, rejection, or non-travel.
3.4 Toshan Travels shall not be responsible for refund denials, partial refunds, or delays caused by Suppliers.

4. Refund Processing & Mode

4.1 Refunds shall be initiated only after the refundable amount is received from the Supplier.
4.2 Refund processing may take 7–15 working days or longer, depending on Supplier timelines, banking procedures, and payment gateway processing.
4.3 Refunds shall be made to the original mode of payment only. Any payment gateway, banking, or transaction charges shall be borne by the Client.

5. Partial Utilization, No-Show & Amendments

5.1 No refund shall be provided for no-show cases, early check-outs, unused services, or partially utilized services unless expressly permitted by the Supplier.
5.2 Any amendment, rescheduling, or name change shall be subject to Supplier policies and additional charges, which shall be payable by the Client.

6. Force Majeure & Uncontrollable Events

The Company shall not be liable for any refund, compensation, or damages arising due to events beyond its control, including but not limited to acts of God, natural disasters, pandemics, epidemics, government orders, travel restrictions, airline operational issues, strikes, political unrest, or technical failures.

7. Limitation of Liability

7.1 Toshan Travels shall not be liable for any indirect, incidental, special, punitive, or consequential losses, including loss of enjoyment, mental distress, or financial loss.
7.2 In all circumstances, the maximum liability of Toshan Travels shall be limited strictly to the amount of service fees actually received by the Company, excluding amounts paid to Suppliers.

8. Indemnity

The Client agrees to indemnify and hold harmless Toshan Travels, its directors, employees, and agents from any claims, losses, damages, legal costs, or liabilities arising due to cancellation disputes, supplier defaults, or Client’s failure to comply with Supplier terms.

9. Finality of Decision

All decisions taken by Toshan Travels with respect to cancellations and refunds shall be final and binding, subject to Supplier confirmation and applicable laws.

10. Governing Law & Jurisdiction

This Policy shall be governed by and construed in accordance with the laws of India, and all disputes shall be subject to the exclusive jurisdiction of the courts of New Delhi, to the exclusion of all other courts.
